Exceptional English Terms and Conditions of Service

Payment

   
   
2. Money due but unpaid by the Client shall bear interest at a rate equivalent to that set by the Royal Bank of Canada for overdraft accommodation as certified by Exceptional English at the due date, plus 2% p.a.
3. If the Client fails to comply with these terms and conditions of payment, then Exceptional English shall be entitled to treat such failure as a fundamental breach of contract and to treat the Contract as repudiated. Exceptional English shall be entitled to apply such monies as it may already have received in respect of the Services towards any damage suffered by Exceptional English.
   
         
    Delivery    
   
4. Where Exceptional English delivers the Services, Exceptional English will make reasonable attempts to effect delivery within the time agreed upon by the parties as the deadline.
5. Where Exceptional English makes delivery of the Services electronically via the Internet, Exceptional English makes no warranty that the delivery of Services will be uninterrupted, timely, secure or error free. Exceptional English shall not be liable for any loss, including that arising from loss or corruption of data, interruption, suspension, inability to access, or termination of service suffered by the Client.
